1. Orders
Orders for standard and special materials are binding for the customer. Once production has started, cancellations or reductions of the order will not be accepted, unless the customer reimburses AFP Tech Srl for the material and processing costs incurred up to the date of suspension.
2. Prices
Prices are those in force on the date of the order. All prices refer to goods delivered Ex Works (EXW) from our factory.
3. Delivery Terms
Only delivery terms indicated by AFP Tech Srl shall be considered valid. Such terms are, in any case, to be considered indicative only and are not legally binding.
In the event of difficulties in material procurement, strikes or any other cases of force majeure, delivery terms shall be automatically extended without AFP Tech Srl being liable for any compensation or damages of any kind.
The customer remains, in all cases, obliged to collect the ordered material once it is ready for shipment.
4. Shipments
Shipments are entirely at the customer’s expense and are carried out at the customer’s risk and responsibility.
Claims regarding any shortages must be submitted within 8 (eight) days from receipt of the goods.
Should it be agreed that transport costs are borne, even partially, by AFP Tech Srl, the company reserves the right to choose the means of transport and shipping methods.
5. Warranty
AFP Tech Srl undertakes to repair or replace free of charge products that it acknowledges as defective.
The warranty shall become void if the parts returned as defective have been repaired or tampered with without AFP Tech Srl’s authorization.
Repairs of defective parts carried out by the customer shall only be recognized after prior authorization by AFP Tech Srl and approval of the related cost estimate.
AFP Tech Srl shall not accept any liability or provide any compensation for damages occurring during the use of its products, even if such products are defective.
6. Payments
Only payments made according to the agreed terms and conditions shall be considered valid.
After the payment deadline has expired, AFP Tech Srl shall apply late payment interest at a rate 3% higher than the legal interest rate applied by the bank.
In the event of delayed or missed payments by the customer, AFP Tech Srl reserves the right to suspend deliveries of ongoing orders or request advance payment, without granting the customer any compensation or damages.
Any dispute concerning materials currently under production or already in the customer’s possession shall not release the customer from the obligation to pay for the goods on the date specified in the order confirmation.
7. Ownership
All goods shipped shall remain the property of AFP Tech Srl until full payment of all related invoices has been received.
8. Jurisdiction
Any dispute arising from commercial relations with AFP Tech Srl shall fall under the jurisdiction of the Court of Lecco (LC, Italy).
